Terms and Conditions

RTFM Design grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable license to install and use the Software in accordance with this Agreement.

Evaluation use

If the Software is provided for trial or evaluation, the license is limited in duration or features as described by the Software, website, or order page.

Paid license

If you purchase a paid license, and subject to your compliance with this Agreement, RTFM Design grants you a license for one individual user to install and use the Software on up to five (5) computers that are owned or controlled by that same user.

A license is granted per user, not per organization, unless otherwise expressly agreed in writing.

You may:

• install and use the Software on up to five (5) computers, provided all such installations are used only by the same licensed user;
• make a reasonable number of copies of the Software solely for backup or archival purposes, provided all proprietary notices are preserved; and
• use the Software for your personal or internal business purposes.

You may not:

• permit any other individual to use the Software under your license except as expressly allowed above;
• share, sublicense, rent, lease, lend, sell, assign, redistribute, or otherwise transfer the Software or your license rights;
• modify, adapt, translate, or create derivative works based on the Software;
• reverse engineer, decompile, disassemble, or otherwise attempt to derive source code or underlying ideas, except to the extent applicable law expressly prohibits such restrictions;
• remove, alter, or obscure proprietary notices, labels, or copyright notices;
• copy the Software except as expressly permitted by this Agreement; or
• use the Software in any unlawful manner or in a way that interferes with the Software, our systems, or the rights of others.

The Software is licensed, not sold. RTFM Design and its licensors retain all right, title, and interest in and to the Software, including all copyrights, trade secrets, trademarks, and other intellectual property rights.

Purchases may be processed by an authorized third-party payment processor or merchant of record. Your order, billing, payment, taxes, refunds, and related checkout matters may also be subject to that provider’s terms and policies.

Unless explicitly stated otherwise at the time of purchase, the RTFM Player license is a one-time license purchase and not a subscription.

The Software may require a valid license key, activation, or verification to enable full use after any trial period. You agree not to bypass, disable, or interfere with license enforcement or activation mechanisms.

RTFM Design may, but is not obligated to, provide updates, bug fixes, patches, upgrades, or support. Unless we state otherwise, any updates we provide are considered part of the Software and governed by this Agreement.

This Agreement will terminate automatically if you fail to comply with its terms.

Upon termination, you must stop using the Software and destroy or remove all copies of the Software in your possession or control, including backup copies.

Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitation of liability, and governing law provisions.

THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, RTFM DESIGN DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

YOU ASSUME THE ENTIRE RISK AS TO THE QUALITY, PERFORMANCE, AND USE OF THE SOFTWARE. SHOULD THE SOFTWARE PROVE DEFECTIVE, YOU ASSUME THE ENTIRE COST OF ANY NECESSARY SERVICE, REPAIR, OR CORRECTION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RTFM DESIGN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, BUSINESS INTERRUPTION, COMPUTER FAILURE, OR OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO THE SOFTWARE OR THIS AGREEMENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RTFM DESIGN’S TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SOFTWARE OR THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE LICENSE GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain warranty exclusions or liability limitations, so some of the above may not apply to you.

You agree to comply with all applicable laws and regulations in connection with your use of the Software, including export control and sanctions laws where applicable.

This Agreement is governed by the laws of the State of New York, without regard to its conflict of laws rules, except where mandatory law requires otherwise.

Any dispute arising out of or relating to this Agreement shall be brought in the state or federal courts located in New York, NY, and you consent to their jurisdiction and venue.

This Agreement constitutes the entire agreement between you and RTFM Design regarding the Software and supersedes prior or contemporaneous understandings on that subject, except for any separate written agreement signed by RTFM Design.

If any provision of this Agreement is held unenforceable, the remaining provisions will remain in full force and effect to the maximum extent permitted by law.
